Aug 28, 2023 Meeting

Due to the failure of the board to fulfill their fiduciary responsibilities, the homeowners convened a meeting on August 28, 2023. During this meeting, we, the SPC homeowners, voted to remove Stephanie P., Karen H., and Michael K. from the board. Since that meeting, the three people have continued to act as the Board, thereby ignoring the community’s wishes. Throughout the rest of this site, the three people will be referred to as the ousted Board.

The consensus was resolute: the ousted members had to step down for the greater good. I was elected as the interim board president, joined by Juan V. as Vice President, Gina S. as Secretary, and Karl H. as Treasurer. Teri B. stepped up as an Officer, alongside our dedicated volunteers: Bronita W., Debbie V., and Edward T., who were all welcomed to our interim board.

Despite facing challenges, including intimidation by the ousted board, the property manager, and a baseless lawsuit, I stand as the sole remaining member of the interim board elected to serve you. The ousted board members pressured and bullied the many of the others into signing a false affidavit to remove themselves from the lawsuit. I refuse to be threatened or bullied by the ousted board or by Jim M. We, as homeowners of the Condominiums, understand what is right, and together we recognize that the ousted board does not serve our best interests.

The Challenge

The previous board members are refusing to step aside and are continuing to misuse our funds. They've hired attorneys from Sanford Phoenix to maintain their positions and keep the interim elected board members off the board. Consequently, your HOA fees are being used to fund the lawsuit that hinders the changes we all desire.

It is possible that the board may have spent over $40,000 of our money to fight their removal. These funds could have been allocated for crucial repairs, like fixing potholes, trimming dead trees, or maintaining our buildings. Regrettably, they are continuing to use our HOA fees to fight their removal. *note: this expense is not on the budget.

The ousted board's Motives

You may be questioning why the ousted Board is willing to spend your money to hold onto their positions on the board when it is obvious that we want them gone. Board membership is a choice made without financial reward, so why the insistence on remaining? Last year at the annual meeting, Stephanie P. suggested that I wanted to join the board just to remove Prism Realty. However, we should truly be asking why she is so determined to keep Prism employed by us, especially when they are not fulfilling their responsibilities. Could it be that she and the other members are receiving some benefit from Prism or Jim M.? This raises an important concern: are our funds—possibly more than $40,000 so far—being used to protect Prism instead of improving our community? The ousted board does not want me or anyone else on the board—a position you elected me for—because they know I would have access to financial documents that could reveal their misuse of our funds.

Actions I have taken on your behalf

Despite facing threats and intimidation from the ousted Board, including a baseless lawsuit aimed at me, I refuse to be intimidated. We need to stop them from misusing our HOA fees. I have spent over $21,000 of my own money to combat this unfounded lawsuit and make the necessary changes. My commitment to fighting for you is unwavering, and to ease the financial burden, I’ve set up a GoFundMe to help cover these costs. Your support can make a difference in our battle for a better community!
