Hello! You might know me as Cherié, the redhead who walks the dogs, or perhaps as the individual you elected to be your HOA Board President. If you're puzzled about why Stephanie P., Michael K., and Karen H. are still presenting themselves as the HOA board, rest assured you're not alone. As you know, during the meeting on August 28, 2023, we voted these people off the board, yet they have not stepped down.

This website is your resource for staying updated on efforts to honor your votes and to ensure an honest and ethical board is installed. Here, you'll discover the lengths the ousted HOA board has gone—and continues to go—to cling to power, including their initiation of a baseless lawsuit. I will keep you informed about my efforts to challenge the board and advocate for the rights and desires of all Sunset Park Condominiums homeowners. Clarifying a Misconception

Before we dive into the posts, I want to clarify two important points.

  • First, Jim Meyers, the owner of Prism Realty, is NOT a member of the Sunset Park Condominiums HOA Board. He does not own the land on which your condo is situated and has no say in how we use our HOA fees nor does he have a say in the decisions we make regarding our community. Prism Realty is simply the management company we have hired to help ensure the smooth operation of our association; Jim Meyers is just an employee in this capacity.
  • Second, your HOA fees do not go into Jim Meyers' or Prism Realty’s bank account. Instead, these fees should be deposited into the bank account of the Sunset Park Condominiums Association. The HOA Board is responsible for using these funds to pay Prism Realty and other contractors for their services, as well as covering other condominium expenses, such as water, sewer, and lawn maintenance. In essence, we are the employers of Prism Realty and other contractors, and our HOA fees fund their services.

Clarification of HOA and roles on BoARD

The Sunset Park Condominiums (SPC) Homeowners Association (HOA) consists of all homeowners within the Sunset Park Condominiums. The HOA is governed by a Board made up of fiduciaries. Fiduciaries are individuals who act on behalf of the homeowners and are required to prioritize the homeowners’ interests above their own, preserving good faith and trust. They are legally and ethically obligated to act in the best interests of the homeowners.

Before August 28, 2023, the SPC HOA Board had three members occupying three positions, despite the bylaws requiring a minimum of five positions. The board members were Stephanie P., Karen H., and Michael K.  Jim Meyers (owner of Prism Realty) is NOT a board member and has NO say in what you do or how you do it.

Although the Sunset Park Condominiums HOA operates as a non-profit organization with volunteer board members, it must still adhere to corporate laws. This means that the HOA board has a fiduciary duty to act in the best interests of both the association and its members. NO individual shall receive any financial or personal benefit from serving on the board.

What does this mean for you? It signifies that our HOA board has a legal responsibility to prioritize the community’s interests over all else, including their own. The Board's legal obligations include, but are not limited to:

  • Ensuring that contracts with individuals or organizations are honored;
  • Avoiding any conflicts of interest, including not being compensated for services while serving on the board;
  • Ensuring that funds collected for the association, such as HOA fees, are utilized for the benefit of the community;
  • Full transparency of all money spent.
